Namibia Sports Commission Court Ruling: Performance Appraisal Sham Exposed (2026)

A High Court ruling has revealed a shocking truth about the performance appraisal process at the Namibia Sports Commission (NSC). The court declared that the assessment prepared by NSC's chief administrator, Freddy Mwiya, for ex-finance head Junias Thomas Hamalua, was nothing but a 'sham'. This revelation has sparked controversy and left many questioning the integrity of the evaluation system.

The court's decision was based on the fact that Mwiya's performance analysis, conducted in February 2023, did not adhere to the contractual requirement of continuous, annual evaluations. Judge President Shafimana Ueitele highlighted that there was no evidence of how Hamalua's performance was appraised throughout his five-year contract term, which ended in May 2023.

But here's where it gets even more intriguing. The interim board had already made its decision on January 28, 2023, not to renew Hamalua's contract. Despite this, Mwiya proceeded to recommend renewal, a move that the court deemed to have no legal authority.

Hamalua, who joined the commission in 2017, sought to overturn the board's decision, arguing that the interim board was unlawfully appointed and that Mwiya should have been the decision-maker regarding contract renewals. However, the court rejected these claims, emphasizing that the board's decision was contractual and not subject to judicial review.

The Namibia Sports Act further clarified that Mwiya operates under the board's control and direction and cannot independently approve contract renewals. Court documents obtained by the Windhoek Observer revealed that the interim board had informed Mwiya in November 2022 that Hamalua's contract would not be renewed.

Despite this clear instruction, Mwiya produced a performance appraisal recommending renewal, which the board promptly rejected. The board's decision remained valid and binding, and the later confirmation by Mwiya did not change the legal outcome.

And this is the part most people miss: the court's ruling not only highlights the importance of following contractual procedures but also sheds light on the power dynamics within the NSC. It raises questions about the role and authority of the chief administrator and the interim board.
